Human Eat Tech Pty Ltd (“Human Eat Tech”, “HET”, “we”, “our” or “us”) operates the HET mobile application and related services collectively referred to as the “App”.
These Terms and Conditions (“Terms”) govern your access to and use of HET.
By downloading, accessing, creating an account or using HET, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, you must not use the App.
1. Eligibility
HET is intended for users aged 13 years or older.
By using the App, you confirm that you meet the minimum age requirement and have the legal capacity to agree to these Terms.
If you are under the age of legal majority in your location, you should use HET only with the permission of a parent or legal guardian.
2. Purpose of HET
HET is a private journal and autobiography application designed to help users:
Record daily events and personal thoughts
Write notes and messages to themselves
Record and save voice entries
Save photographs and other personal media
Revisit previous memories
Organise memories by date, year, people and place
Develop personal stories and autobiography chapters over time
Save selected moments to a dated life timeline
Export or back up their information where those features are available
HET is a personal recording and organisation tool.
HET is not a medical device, diagnostic system, counselling service, mental health service, emergency service or professional authority.
HET is not intended for emergencies or crisis situations.
Any meaning, interpretation or decision arising from content recorded in HET remains the responsibility of the user.
3. Accounts and Sign-In
HET may allow you to:
Continue using a temporary or anonymous Get Started account
Sign in using Apple
Sign in using Google
Connect a temporary account to Apple or Google later
You are responsible for maintaining access to the Apple or Google account connected to HET and for keeping your device and login credentials secure.
A temporary Get Started account may not be recoverable if you log out, delete the App, lose access to your device or clear the App’s local data before connecting a supported sign-in method or completing an available backup.
You must not create an account using another person’s identity or access another person’s HET account without permission.
4. User Content
HET allows you to create, upload, record, organise and store content, including:
Journal entries
Personal notes and messages
Voice recordings
Transcripts
Photographs
Profile details
Dates and life events
Information about people
Places and location information
Memories
Chapters and autobiography writing
Emoji entries and usage counts
Other information you choose to save
This information is referred to as “User Content”.
User Content is private by default and is not made publicly visible through HET unless a future sharing feature clearly gives you that choice and you actively choose to share it.
HET does not currently operate as a public social network and does not provide general user-to-user posting or public profile features.
5. Ownership of User Content
You retain ownership of your User Content.
By using HET, you grant Human Eat Tech a limited, non-exclusive, worldwide and revocable licence to host, store, copy, transmit, back up, synchronise, process and display your User Content only as reasonably necessary to:
Operate the App
Provide features you request
Back up and synchronise your information
Display your information to you
Process exports and account deletion
Maintain the security and reliability of the service
This licence does not transfer ownership of your User Content to Human Eat Tech.
The licence ends when your User Content is deleted from our active systems, subject to reasonable technical, legal and backup-retention requirements.
6. Content Involving Other People
You are responsible for the content you add to HET.
Before uploading photographs, recordings or personal information involving another person, you should ensure that you have the legal right or appropriate permission to do so.
You must not use HET to unlawfully record private conversations, infringe copyright, violate another person’s privacy or store unlawful material.
Human Eat Tech does not verify the accuracy, ownership or lawfulness of User Content before it is added.
7. Device Permissions
Some features may require permission to access your device’s:
Camera
Microphone
Photo library
Files
Location
Notifications
Device security features
You may refuse or withdraw permissions through your device settings, although some features may no longer function correctly.
HET will use these permissions only to provide the related feature.
8. Acceptable Use
You agree to use HET only for lawful purposes.
You must not:
Interfere with or disrupt the App or its systems
Attempt to gain unauthorised access to another account, database or system
Introduce malicious code or harmful material
Attempt to bypass security or usage restrictions
Use automated systems to overload or misuse the service
Reverse engineer, reproduce, resell or commercially exploit the App except where permitted by law
Use HET to infringe the rights, safety or privacy of another person
Use HET for fraudulent, abusive or unlawful activity
We may restrict, suspend or terminate access where reasonably necessary to protect users, Human Eat Tech, our systems or the integrity of the service.
9. Local Storage, Cloud Backup and Syncing
HET may store information locally on your device, through cloud services or through a combination of both.
Available storage and syncing features may depend on:
Your account type
Whether you have connected Apple or Google
Your internet connection
Device permissions
The version of HET you are using
Whether cloud backup or syncing has been enabled
HET may use Google Firebase services to provide authentication, database storage, file storage, backup and syncing.
Cloud backup and syncing do not guarantee that every item will upload immediately or that all data can always be restored.
Uploads may be delayed or interrupted by poor internet connectivity, device settings, storage limits, service outages, corrupted files or other technical issues.
You should confirm that important photographs, recordings and memories have successfully saved or synced.
Where available, HET may allow you to export a copy of your data. Users should maintain an independent copy of information that is especially important to them.
10. Data Loss and Service Availability
We take reasonable steps to protect and maintain the service. However, no application, device, database, storage provider or network is completely secure or error-free.
HET does not guarantee:
Uninterrupted availability
Permanent retention of every item
Error-free syncing
Successful restoration of every file
Compatibility with every device
That third-party platforms will remain available
To the extent permitted by law, Human Eat Tech is not responsible for data lost because of:
Device loss, damage or failure
Removal of the App
Loss of access to a connected account
User error
Failure to complete a backup
Internet or service interruption
Actions of Apple, Google or another service provider
Events outside our reasonable control
Nothing in this section excludes rights that cannot legally be excluded.
11. Privacy
Our handling of personal information is explained in the HET Privacy Policy.
By using the App, you acknowledge that User Content may be processed and stored by service providers used to operate HET.
We do not claim ownership of your personal stories, recordings, photographs or memories.
We do not sell User Content for advertising.
12. Third-Party Services
HET may rely on services provided by third parties, including:
Apple
Google
Firebase
App stores
Cloud-hosting providers
Email and customer-support providers
Your use of those services may also be governed by their own terms and privacy policies.
Human Eat Tech does not control and is not responsible for the independent operation, availability or policies of third-party services.
13. Payments and Subscriptions
HET may offer paid features, subscriptions or in-app purchases.
Payments are processed by Apple, Google or another authorised payment provider. Human Eat Tech does not directly collect or store your complete payment-card details.
Prices, subscription periods, included features and renewal conditions will be shown before purchase.
Subscriptions may renew automatically unless cancelled through the relevant platform account settings.
Refunds and billing disputes are generally governed by the policies of the applicable app store or payment provider, subject to rights available under applicable law.
14. App Updates and Feature Changes
HET may be updated, improved or changed over time.
We may:
Add or remove features
Change the way features operate
Introduce storage or usage limits
Release beta or experimental features
Stop supporting older App versions or devices
Temporarily suspend features for maintenance or security
We will take reasonable steps to avoid unnecessary disruption, but we do not guarantee that every feature will remain available permanently.
15. Beta and Test Versions
Some versions of HET may be provided through TestFlight or another testing service.
Beta versions may contain unfinished features, errors, interruptions or changes that have not yet been released publicly.
You should not rely on a beta version as the only permanent copy of important information.
Feedback supplied during testing may be used to improve HET.
16. Account Deletion
You may stop using HET at any time.
Where account creation is supported, HET provides an in-app process for initiating account deletion.
Deleting your account may permanently remove:
Your HET account
Cloud-stored journal entries and memories
Cloud-stored profile information
Photographs and voice recordings stored by HET
Chapters, people, places and related records
Other information associated with your account
Information stored only on a device may need to be deleted separately from that device.
Deletion may not be immediate. Limited information may remain temporarily in technical logs, backups or records that Human Eat Tech is legally required to retain.
Once account information has been permanently deleted, it may not be recoverable.
17. Suspension and Termination
We may suspend or terminate access where:
You materially breach these Terms
Your use creates a security or legal risk
We are required to do so by law
Continued access could harm Human Eat Tech, another person or the service
The service is discontinued
Where reasonably possible, we will provide notice before terminating an account unless immediate action is required for security, legal or safety reasons.
18. No Monitoring or Duty to Intervene
HET is primarily a private journaling and personal-recording service.
Human Eat Tech does not routinely read, interpret or assess User Content for emotional meaning, medical risk, behavioural patterns or personal circumstances.
We do not undertake to monitor entries, contact emergency services, provide warnings or intervene because of information recorded in HET.
Using HET does not create a medical, therapeutic, fiduciary or emergency duty of care.
19. Disclaimers
HET is provided on an “as is” and “as available” basis.
To the extent permitted by law, we do not make guarantees regarding:
Availability
Reliability
Accuracy
Fitness for a particular purpose
Data permanence
Compatibility
Particular personal or professional outcomes
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or another applicable law.
20. Limitation of Liability
To the maximum extent permitted by law, Human Eat Tech is not liable for indirect, incidental, special or consequential loss arising from your use of, or inability to use, HET.
This may include loss resulting from interrupted access, lost data, missed memories, loss of opportunity or reliance on User Content.
Where liability cannot legally be excluded, our liability is limited to the minimum remedy permitted by applicable law.
21. Platform Disclaimer
These Terms are between you and Human Eat Tech, not Apple Inc., Google LLC or their affiliates.
Apple and Google are not responsible for HET, its content, maintenance, support or claims relating to the App.
Questions, complaints and support requests relating to HET should be directed to Human Eat Tech.
22. Changes to These Terms
We may update these Terms when HET, our legal obligations or our business practices change.
The updated version will display a revised “Last updated” date.
Where a change is significant, we may provide notice through the App, our website or another reasonable method.
Continued use of HET after updated Terms take effect constitutes acceptance of those Terms.
23. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Subject to any rights you have under applicable consumer law, disputes relating to these Terms are subject to the jurisdiction of the courts of New South Wales.
